Dominic Benthall

Dominic is an experienced and formidable advocate, having appeared in cases across the full spectrum of the criminal law. He is particularly experienced dealing with vulnerable witnesses and defendants. He is renowned for his thorough preparation and attention to detail.

Dominic has considerable expertise in complex boiler-room frauds having prosecuted on behalf of the SFO and is on the CPS Advocates Panel at Grade 3.

Defence

Defence cases concluded in 2017:

R v RE (Chelmsford CC) – multiple complainant child sex / sexual grooming / sexual assaults by football agent / ‘talent scout’.

R v AP (Croydon CC) – double s.18 wounding (stabbing of two strangers in London park).

R v JL (Basildon CC) – three-handed ‘ram raid’ spree of cashpoints and businesses in Essex using specialist equipment.

R v M A-M (Southwark CC) – importation of cocaine into Heathrow.

R v IS (Croydon CC) – Dominic represented a profoundly obsessive-compulsive defendant in relation to breaching his restraining order.

 

Ongoing defence cases in 2018 include:

R v FA and ors (Southwark CC) – alleged multi-handed conspiracy to import over 100 kgs of cocaine from Brazil into Heathrow, 15 month NCA operation (‘Operation Pulex’).

R v CW (Croydon CC) – allegations of historic rape and other sexual offences within familial and non-familial context.

R v EC (Canterbury CC) – allegation of kidnap and robbery.

In 2013, Dominic defended in R v ZA and ors (Central Criminal Court) – multi-handed sex offences (‘Operation Bullfinch’ – the Oxford grooming case – led by QC)

Dominic regularly defends in cases involving allegations of serious violence, fraud and possession with intent to supply / importation of Class ‘A’ drugs.
Dominic is also privately instructed to advise and defend in driving cases.

 Dominic accepts instructions on a Direct Access basis.

Prosecution

Prosecution cases concluded in 2017
:

R v SC (Maidstone CC) – armed robbery of Kent bookmakers.

R v DB (Kingston CC) – s.18 GBH by stepson on elderly stepfather. Case resulted in 12 years imprisonment with 4 years extended licence.

R v GG (Isleworth CC) – s.18 wounding. Complex considerations of interrelationship between self-defence and insanity defence. Defendant had not left house once in 9 years – entrenched belief that he was under state surveillance at all times. Jury rejected insanity defence.

R v CF + LB (Oxford CC) – £62,000 fraud by Britwell parish councillors. LB gave Queen’s Evidence against CF.

 

Ongoing prosecution cases in 2018 include:

R v JW, GC and AS (Snaresbrook CC) – allegations of double s.18.

R v MG (Isleworth) – allegation of s.18 wounding.

In August 2017, Dominic was appointed to the Serious Fraud Office Prosecution Panel (effective until 1st August 2021).

Dominic has significant experience in fraud cases, having prosecuted two trials for the Serious Fraud Office (as junior counsel led by QC) (R v AS – Ipswich CC, R v DP and six ors – Ipswich CC), as well as appearing in the Court of Appeal (Criminal Division) on behalf of the SFO. He has also acted as disclosure junior in a large number of other SFO cases.
