John Waller is successful at the Court of Appeal

On 21st July 2016 John Waller successfully argued that an original sentence of 25 months was manifestly excessive and the Court of Appeal reduced the sentence to 18 months.

The Appellant had been sentenced to a total sentence of 25 months imprisonment for Breach of a Sexual Offences Prevention Order and a Sexual Assault. The Appellant had a very relevant, and recent, previous conviction for 8 offences of Sexual Assault which were committed in exactly the same circumstances as the current offence. John Waller successfully argued before the Court of Appeal that the starting point identified was too high and the sentence was therefore manifestly excessive.
