Chloe Carvell acts for Sergeant in the Military charged with assault occasioning actual bodily harm against junior soldier

Sergeant Q escaped a period of service detention and imprisonment after pleading guilty to assault occasioning ABH against a junior soldier whilst on a navigation exercise in Estonia.

Sergeant Q admitted to punching the junior soldier twice (causing bruising, concussion and mild bleeding to the eye), following the junior soldier disobeying the ‘two pint’ rule.

Sergeant Q was sentenced to a 24-month Service Community Order with unpaid work and a rehabilitation activity requirement and compensation. Sergeant Q was dismissed from HM Services as a result.

This case follows the recent guidance on Sentencing in the Service Courts, effective from 1st June 2023 which states dismissal should be considered in cases of ABH when culpability is assessed as ‘B’ or above and/or harm is assessed as Category ‘2’ or above.
