Helen’s client, C, was charged with aggravated burglary, having been captured on CCTV entering a takeaway shop, armed with a machete and tried to stab the Complainant; the issue was identification. Following successful legal arguments to exclude the purported identification, the Crown were forced to offer no evidence in respect of aggravated burglary.
