Beth Crocker and Clodaghmuire Callinan secure kidnap acquittal.

Beth and Clodaghmuire represented 2 brothers who had been charged with kidnap of a 15 year old boy.  The defendants’ father, a delivery driver, was lured to a property in order to make a delivery when he was stolen from and ended up on the ground being strangled by one of the thieves.  Having told his sons what happened it was alleged that they drove around the area looking for his attackers.  They came across 2 boys, one of whom escaped and one of whom said he was forced to get into the defendants’ car, assaulted and then driven back to the father and eventually dropped off in the street.  A member of the public reported hearing shouting in the street and a male being forced into a car.

It was the defendants’ case that the boy apologised for the theft when he was caught and willingly got into the car.  The defendants were taking him back to their father where they assumed that the police were waiting.

The case was listed for trial.  However, following representations made to the Crown as to the difficulties in its case, the prosecution offered no evidence on the kidnap charge.  The defendants accepted a police caution for a public order offence.
