Clare Dowse has succeeded in having her client’s conviction in an English Channel ‘small boats’ case overturned by the Court of Appeal.
Clare’s client was among seven Appellants who were granted leave to apply out of time to appeal their convictions, following the judgments by the Court of Appeal in the cases of Kakaei and Bani & Ors in 2021. Clare’s argument that a fundamental misdirection of law during her client’s trial rendered the conviction unsafe was successful.
No re-trial was sought by the Crown.
Clare was instructed in this case by Martin Morrow of Henry Hyams Solicitors, Leeds.
