Jim Olphert secured an unlikely suspended sentence for a client convicted of possession of false identity documents with improper intention after trial. The client had been resident here on a false ‘indefinite leave to remain’ visa for over 10 years.
Convicted in March, the client faced sentence for the offence, which usually warrants a sentence of immediate custody.
Jim successfully persuaded the court adjourn for a pre-sentence report, and on the sentence date, made submissions leading to the imposition of a short suspended sentence in circumstances where a long period in custody would have been ruinous to his right to live and work in this country.
