Following three days of legal argument John Waller secured a rare stay of prosecution at Inner London Crown Court. It had been alleged by the prosecution that the defendant was involved in a joint-enterprise ABH which resulted in the glassing of the complainant in the face. It was successfully argued by John that emails sent to his client from an officer showed unequivocally that the case was not be pursued against her and that she had acted to her detriment by not providing a statement to the prosecution when asked. The Judge agreed with the submissions and stayed the prosecution as an abuse of process.
