Rupert Hallowes’s client acquitted of supplying Class A drugs

Rupert Hallowes, instructed by David Smith of Frame Smith Solicitors, secure their clients’ acquittal of supplying Class A drugs and other offences following a two-week trial at Guildford Crown Court.

Rupert’s client was arrested as part of a substantial investigation into county lines drug dealing. Communications between Rupert’s client and a defendant who had pleaded guilty to conspiracy to supply Class A were identified. On arrest, the police found in the flat of Rupert’s client a drugs phone containing evidence of very recent street dealing over the course of two months and a large quantity of cash.

Following a submission of no case to answer, the trial judge concluded, in accordance with the principles in R v Shillam, that no jury properly directed could convict Rupert’s client of the indicted conspiracy. The jury was directed to return a not guilty verdict at the close of the Crown’s case. Rupert’s client gave evidence. While the jury convicted the co-defendant of the indicted conspiracy, Rupert’s client was acquitted of an alternative count of being concerned in the supply of Class A drugs and possession of criminal property.
