Pupil barrister Anoushka Twining successfully opposed an application for a criminal behaviour order (CBO)

Pupil barrister Anoushka Twining successfully opposed an application for a criminal behaviour order (CBO) against Rowan Lascelles at City of London Magistrates Court this week.

The application was advanced by the Metropolitan Police Service, with a single condition for Mr Lascelles to be excluded from the Borough of Westminster, an area he currently resides in and where he accesses drug and accommodation support.

The application was opposed on the basis that the supporting witnesses could not confidently state that the CBO would prevent further offending, either inside the Borough of Westminster or outside. It was not accepted by the defence, or ultimately by the court, that the stronger sentencing powers that would be available to punish Mr Lascelles was a suitable ground for the granting of the CBO as suggested by the supporting witnesses.

Anoushka was instructed by John Howey of JFH Law
