Rape acquittal at Guildford Crown Court for Rupert Hallowes’ client following an alleged offence in 2019

Rupert Hallowes, instructed by David Smith of Frame Smith Solicitors, secured the acquittal of his 22-year-old client who had been indicted with rape. The allegation dated back to June 2019 when Rupert’s client was 17 years of age and the complainant (someone with whom he had previously had consensual sexual relations) was 18 years of age. The Defendant was not charged until early 2023. Following an application made under section 41 YJCEA 1999, the court permitted the defence to ask the complainant questions about the extent of the previous sexual relationship between the parties. A section 28 cross-examination took place in June 2023. The Crown relied upon text messages between the two parties following the indicted event and comments made upon arrest in which the Defendant appeared to be making admissions to the offending. Following a 7 day trial, the jury acquitted Rupert’s client on 24th December 2024.
