Rupert Hallowes successful in rape / sexual activity with a child trial

Rupert’s 20 year old client was indicted with 3 counts of rape and, in the alternative, 3 counts of sexual activity with a 15 year old girl. He was also alleged to have physically assaulted the same complainant. At the time of the alleged events Rupert’s client had very recently been made subject to a sexual risk order prohibiting him from having any contact with any female child under the age of 18. He was accordingly also indicted with breach of the sexual risk order. During the 8 day trial Rupert successfully opposed an application to adduce a substantial volume of non-conviction bad character material and a late application to add further counts to the indictment. During cross-examination of the complainant and her mother, Rupert was able to demonstrate numerous inconsistencies between their respective versions of events and the independent evidence. Rupert’s client did not give evidence. Following 3 days of deliberations, the Guildford jury acquitted of all counts apart from the one count of breach of a sexual risk order.
