Stephen Akinsanya, instructed by Kunle Balogun of Achom and Partners successfully represents Defendant charged with aggravated burglary following an incident involving 2 assailants forcefully entering a property with Zombie Knives.
The issue was one of identification following the initial description of the assailants, and phone attribution. After a 5-day trial at Southwark Crown Court, the jury returned a unanimous not guilty verdict in less than two hours. Despite two witnesses picking the defendant out on an identification parade, this was not corroborated by the first description which contained distinguishing features that the defendant did not have. The case demonstrated the need for attention to the detail of first descriptions and subsequent purported correct identifications.
