Tana Adkin KC leading Rani Dulay of 1MCB and instructed by Len Furlong of LF Law represented Moussa Traore, who was acquitted for the second time following a trial for Manslaughter.
The case arose out of an incident close to Waterloo Station in October 2022 when a fight started outside the Bar that Mr. Traore was in. Whilst the group of males including the deceased armed themselves with broken bottles and the deceased bottled Mr. Traore’s friend, the first defendant over the head, Mr. Traore remained inside the Bar. His actions when he came out of the Bar more than 3 minutes after violence had erupted were accepted by the jury as being defensive.
Mr. Traore had originally faced a charge of Murder at an earlier trial which was dismissed at the end of the Prosecution case following submissions made by Miss Adkin assisted by Miss Dulay and Mr. Furlong.
The case has received press attention due to the previous jury acquitting Mr. Traore and the other defendants before advising the court that they had made a mistake. An application to the High Court urging the Court to recognise the Not Guilty verdicts, the defendants and the jury having been discharged, failed. The second jury, a year later has reached the same conclusion within 55 minutes of their retirement.
