Chloe served an extensive written application to dismiss the charge, submitting that the Crown were unable to prove the aggravated element of the offence due to inconsistencies in witness accounts, lack of forensic evidence relating to the weapons and the fact serious injuries were sustained by MR and his co-defendant (IR). This resulted in the Crown reviewing the case again and offering no evidence.
MR and two others (IR and LR) were charged with an aggravated burglary from September 2020 which resulted in MR sustaining stab wounds to his arm and chest and IR sustaining stab wounds to his head, groin, and legs, which resulted in him being placed in an induced coma. Four out of the five complainants also sustained knife inflicted wounds and were treated at hospital.
