Following three days of evidence including expert evidence, Gabriella Fearns made a submission of no case to answer, unusually at the close of the defence case, which resulted in the acquittal of her client at Harrow Crown Court of being the owner of a dog dangerously out of control where a person is injured.
In making submissions Gabriella focused on how the defence expert evidence undermined the prosecution case and was irreconcilable with the evidence of the main prosecution witness such that there was no case to answer. Gabriella was instructed by Wheldon Law.
