Tim Starkey’s client unanimously acquitted of rape, despite confessions in interview.

Following a trial at Harrow Crown Court, the defendant was acquitted of both charges of raping his partner. The police investigation had begun after the Defendant told first his partner, then police, that he had sexual assaulted his 7 year old step daughter. Shortly afterwards, the Defendant’s partner reported to police that she herself had been raped by him on 2 occasions. The Defendant made multiple confessions to raping his partner in interview. However, evidence from a forensic psychologist raised the serious risk that these were false admissions, based on his guilt at sexually assaulting his step daughter, his desire to be punished and his compliant nature. Careful cross examination cast further doubt on the reliability of the prosecution evidence, leading to unanimous acquittals by the jury.
